General Terms of Use Agreement for an Online Store in Compliance with Czech Law
This document is prepared in accordance with Act No. 89/2012 Sb., the Civil Code and Act No. 634/1992 Sb., on Consumer Protection.
1. General Provisions
1.1. These terms and conditions (hereinafter referred to as the “Terms”) regulate the rights and obligations between the online store owner (hereinafter referred to as the “Seller”) and the buyer (hereinafter referred to as the “Buyer”).
1.2. The Seller operates the online store at [gravoartstudio.com] (hereinafter referred to as the “Online Store”), where customers can purchase goods and services.
1.3. The Buyer must read these Terms before placing an order. By placing an order, the Buyer confirms their agreement to the Terms.
2. Conclusion of the Purchase Agreement
2.1. Order and Confirmation: The purchase agreement between the Seller and the Buyer is concluded upon the Seller’s confirmation of the order.
2.2. Price and Payment: All prices include VAT and are valid at the time of order placement. Payments can be made via online payment, bank transfer, cash on delivery, or other available methods.
2.3. Delivery of Goods: The delivery time is specified in the product description. The Seller is not responsible for delays caused by the shipping company.
3. Order Cancellation and Product Returns
3.1. Under Section 1829 of the Civil Code, a consumer has the right to withdraw from the contract within 14 days of receiving the goods without providing a reason.
3.2. Returned goods must be unused, undamaged, and in their original packaging. The return shipping costs are covered by the Buyer.
3.3. Exceptions to the right of withdrawal: Custom-made goods, perishable goods, and personal hygiene products cannot be returned.
4. Warranty and Complaints
4.1. The Seller is responsible for defects that appear within 24 months of receiving the goods.
4.2. Complaints are handled in accordance with Section 2161 of the Civil Code. The Buyer has the right to free repair, replacement, or contract cancellation if the defect is irreparable.
4.3. Complaints can be submitted via the Seller’s email or at the Seller’s registered location.
5. Personal Data Protection (GDPR)
5.1. The Seller processes customers' personal data in compliance with EU Regulation 2016/679 (GDPR).
5.2. Personal data is used only for order processing and will not be shared with third parties without the Buyer's consent, except for delivery and payment service providers.
6. Final Provisions
6.1. These Terms are governed by the laws of the Czech Republic.
6.2. Disputes between the Buyer and the Seller may be resolved through the Czech Trade Inspection Authority (www.coi.cz).
6.3. The Seller reserves the right to modify these Terms. Any changes will be announced on the Online Store’s website.
